WHEREAS, on January 19, 2011, acting pursuant to Sections 36a-494(b) of the 2010 Supplement to the General Statutes and Sections 36a-52(a) and 36a-50(a) of the Connecticut General Statutes, the Banking Commissioner (“Commissioner”) issued a Notice of Intent to Issue Order to Cease and Desist, Notice of Intent to Impose Civil Penalty and Notice of Right to Hearing (“collectively “Notice”) against several respondents, including Respondent;

WHEREAS, the Commissioner alleged in the Notice that Respondent engaged in acts or conduct which formed a basis to issue an order against Respondent to cease and desist from violating Sections 36a-494(b) and 36a-486(b) of the then applicable Connecticut General Statutes and to impose a civil penalty for such violations, subject to Respondent’s right to a hearing on the allegations contained in the Notice;
WHEREAS, on February 1, 2011, Respondent timely filed an appearance and request for hearing;
WHEREAS, Respondent subsequently provided the Commissioner with a sworn statement regarding the matters asserted in the Notice as they relate to Respondent;
WHEREAS, Section 36a-1-55(b) of the Regulations of Connecticut State Agencies provides, in pertinent part, that “[t]he commissioner may withdraw an order at any time before a final decision is issued”;
NOW THEREFORE, based on the sworn statement provided by Respondent, the Notice of Intent to Issue Order to Cease and Desist, Notice of Intent to Impose Civil Penalty and Notice of Right to Hearing issued against Respondent are HEREBY WITHDRAWN.
