The above-captioned matter was heard as a contested case on May 6, 2014, and June 12, 2014, at which time the complainants and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  A petition to intervene by Maximus, Inc., was granted without objection on May 6, 2014, and Maximus, Inc. participated in the contested case as a party.  For purposes of hearing, this matter was consolidated with Docket #FIC 2013-659; Jeff Cohen and WNPR v. Chief Executive Officer, State of Connecticut, Connecticut Health Insurance Exchange; and State of Connecticut, Connecticut Health Insurance Exchange.

     Following the hearing in this matter, the Connecticut Health Insurance Exchange notified the Freedom of Information (“FOI”) Commission on June 26, 2014 and June 27, 2014, by e-mail, that it relinquished its claim of exemption and disclosed without redaction all of the records at issue in this matter.  The FOI Commission takes administrative notice of such e-mail letters. Consequently, the complainants withdrew their complaints by e-mail sent June 27, 2014.  The Freedom of Information Commission takes administrative notice of such e-mail letter.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  Based on the withdrawal of the complaint, the complaint is dismissed.
