The above-captioned matter was heard as a contested case on March 17, 2016, at which time the complainant and the respondents appeared. 

     The complainant moved for a continuance stating that due to the present status of his confinement, he did not have the paperwork he believed he needed to proceed with the hearing.  As the respondents’ counsel began to set forth their reasons for objecting to the motion for a continuance, which included that the complainant had been provided with the requested records, the complainant began to shout at the respondents’ counsel.  The hearing officer attempted to restore order at which time the complainant began to shout at the hearing officer.  The hearing officer advised the complainant that if he did not take direction from her and allow her to conduct the hearing she would close the hearing and dismiss the complaint.  The complainant responded that she should close the hearing.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1. The complaint is hereby dismissed.
