The above-captioned matter was heard as a contested case on January 21, 2016, at which time the complainant and respondents Chief, Police Department, City of New Haven, and Police Department, City of New Haven, appeared and presented testimony, exhibits and argument on the complaint.  The complainant, who is incarcerated, appeared via teleconference, pursuant to the January 2004 memorandum of understanding between the Commission and the Department of Correction.  See Docket No. CV 03-0826293, Anthony Sinchak v. FOIC, et al., Superior Court, J.D., of Hartford at Hartford, Corrected Order dated January 27, 2004 (Sheldon, J.).  The hearing was continued until May 12, 2016. 

     Prior to the continued hearing, the respondents Commissioner, State of Connecticut, Department of Correction, and State of Connecticut, Department of Correction, were made parties to, and received notice of,  the instant matter.  The case caption was amended to include such respondents. 
 
     By letter received and filed with the Commission on May 6, 2016, the complainant withdrew his complaint in this matter.  The Commission takes administrative notice of such withdrawal.

      The following order by the Commission is hereby recommended on the basis of the withdrawal of the above-captioned complaint:

     1.  The complaint is hereby dismissed.
