The above-captioned matter was scheduled to be heard as a contested case on May 29, 2012, at 11:00 a.m., at which time the respondents were present but the complainant failed to appear.  For purposes of hearing, this matter was consolidated with Docket #FIC 2012-642; Michael Nowacki v. Chief, Police Department, Town of New Canaan; and Police Department, Town of New Canaan.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  The complaint is hereby dismissed.
