The above-captioned matter was scheduled to be heard as a contested case on January 18, 2013 and March 14, 2013.  The complainant and the respondents appeared on January 18, 2013, at which time the parties presented the hearing officer with a stipulated agreement in which the respondents agreed to provide the complainant with the records that were the subject of the above-captioned complaint, and the complainant agreed to withdraw the complaint after he received the records.  The complainant did not withdraw the complaint and thus a continued hearing was scheduled for March 14, 2013, at which the respondents appeared but the complainant did not.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1.  The complaint is hereby dismissed for failure to prosecute.
