The above-captioned matter was heard as a contested case on November 5, 2012 at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. Regrettably, however, the Commission became aware that the hearing in the above-captioned matter was not recorded due to technical difficulties related to the upgrading of its computer server.
Consequently, the hearing was reopened and scheduled to be reheard on January 7, 2013.
However, by e-mail dated and filed on January 2, 2013, the complainant indicated that he wished to withdraw his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the complainant’s letter of withdrawal, the complaint is hereby dismissed.
