The above captioned matter was heard as a contested case on February 25, 2013, at which time the complainants and the respondents appeared and presented testimony, exhibits and argument on the complaint.

     Subsequently, the adjudication of this case was deferred as a result of a health issue experienced by counsel for the respondents and the briefing schedule was extended.

     By letter dated May 3, 2013, the complainants informed the Commission that they had received the requested records and wished to withdraw their complaint. The Commission takes administrative notice of such withdrawal.

     The Commission recommends the following order on the basis of the record:

     1. Based on the withdrawal of the complaint, the case is hereby dismissed.
