The above-captioned matter was scheduled to be heard as a contested case on July 12, 2013, at 11:00 a.m.  The respondents appeared, but the complainant failed to appear.

     The hearing officer opened the hearing at 11:16 a.m., and stated for the record, that prior to the commencement of the hearing, the clerk of the Commission contacted the complainant.  At that time, the complainant notified the Commission that he believed the hearing in this matter was scheduled for 2:00 p.m.  Counsel for the respondents represented that he was prepared to proceed with the hearing.  At the discretion of the hearing officer, the matter was continued.

     A continued hearing was scheduled for August 29, 2013.  However, by email, dated August 16, 2013, and filed with the Commission on August 19, 2013, the complainant withdrew the complaint.  The Commission takes administrative notice of such withdrawal.  The continued hearing was cancelled.

     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

     1. Based on the withdrawal of the complaint, the complaint is hereby dismissed.
