Office of Adjudications
In order to facilitate the filing of requests for hearing during the COVID-19 emergency and consistent with the Department’s Temporary Directive, the Office of Adjudications will accept electronically-filed petitions and requests for hearing in addition to petitions or requests submitted by mail . Petitions with required signatures or requests may be filed by email to the Office of Adjudications at www.ct.gov/deep/adjudications or mailed to the DEEP Office of Adjudications, 79 Elm Street, 3rd floor, Hartford, CT 06106. Within 30 days, original petitions or requests that were filed electronically must be also be mailed to the Office of Adjudications at the above-noted address. If the original petition or request exists only in electronic format or signatures were produced using a computer or typewriter, the petition or request must be submitted with a statement bearing the wet-ink signature of the petitioner or requester that the petition or request is only available in that format and has been submitted to satisfy the requirement that an original petition or request be filed.
NOTICE: Section 2-16 of the Connecticut Practice Book provides the process that out of state attorneys must follow in order to appear pro hac vice before Connecticut courts. This rule is now applicable to administrative proceedings before state agencies, including DEEP, effective January 1, 2017. Out of state attorneys are directed to seek appropriate pro hac vice status through the Connecticut Superior Court, judicial district of Hartford, and file proof of such status in the record in each relevant proceeding before the Office of Adjudications.
The Office of Adjudications conducts hearings and issues written decisions in contested cases regarding environmental permitting, licensing and enforcement matters where such hearings are requested by a party or the public or required by law. Hearing officers, also known as Adjudicators, make findings of fact and determine questions of law based on issues presented in a particular case. Such cases may arise under any of the Department's regulatory programs and involve application of substantive and procedural law to the factual record established in each case.
Hearings are conducted in accordance with the Uniform Administrative Procedure Act, the Department's Rules of Practice, and all other relevant law.
